AHHH yes The toys we play with now (kinda like my other thread "technology, then and now," but backwards in a sense).

The toys we played with did us no harm....But the toys NOW a days gets you arrested.(and they aren't really toys), like iPhones, smartphones, whatever the fuck...got this girl in trouble...

I know kids are desensitized with the technology...But Child Porn taken from a child is not like child porn taken from a sick motherfucker who needs to be destroyed...If it was my time, it would have been a polaroid snapshot.. But anyway, do you think the girl should be prosecuted for child porn as the law states???? I think absolutely not, since the "porn" was not set up by an evil bastard, but was just done like shit we did as kids... the only thing now is, we have the technology to capture everything...Should we be holding our children to another level of scrutiny because the "toys" we gave them provided a better picture?? We've all done some shit in the past that can't be proven unlike today...

I think the parents should be responsible for teaching the kids not to fuck around with this shit...Just because it's easier to take a pic now doesn't mean you can go all hustler photo shooting shit..Kids need to learn from their parents... I wonder how this will end up?

Firstly, the law should distinguish between minors and adults who possess this kind of material. Secondly, if she took pictures of other minors having sex, with or without their consent, or if she'd deliberately accessed child porn images, that would be one thing, but the picture was of herself. Aren't child porn laws meant to protect children? So as she's one of the children in the porn, shouldn't she be protected? Just some ideas.

She should still be punished for this, but by her parents, not a government body who'll tag her with a child porn label even though she's a child herself. This charge could stay with her into adulthood and affect her working and personal relationships. I heard of a guy who once had a savage fight with a friend and, because the latter was slightly shy of adult status and the guy was slightly past it, he was charged with assault on a minor. Later, after getting a job at a construction site, the guy's colleagues heard about this charge, thought that it was to do with child sex offences, and beat him up. Law enforcement agencies should think long and hard before dispensing such charges.

EXACTLY!! When I was taking law courses for work, a child that was considered not developed enough to be held responsible for their actions was a certain age (I think 16 and under comes to mind). The kids parents would be held responsible since the kids were not developed mentally enough to take that responsibility on themselves.

And look at it from the point of view of: if this happened when I was young, there would be no prosecution as the technology wasn't up to date to take pics (aside from a poloroid).. This is just kids being kids... There was no evil intent...If anything the intent was out of the kids control since she can still be considered too young to know better...

our government and laws are what we have allowed them to become. Hes is right about laws being meant to protect, yet many are now passed and inacted to control. interpretations of law are a mask for power hungry, high handed bureaucrats. this story actually pissed me off! did the girl do something wrong-yes; should she be prosecuted like a monster-hell no! she's a child.

there are terrorist, psycopaths, organized crime rings and a plethora of other SERIOUS threats that our government and law organizations should be focused on. how many deaths have occurred because of this girl? safe assumption is none.

I don't see what the big uproar is. She had at least one picture of underage kids having sex on her phone. Whether she was in them or not is irrelevant, that's child porn and that's illegal. She shouldn't be tried as an adult, and there is no reason she would be, most likely, but she should certainly be legally punished. If someone underage commits a robbery or any other crime they get arrested and tried. Why not for this too? I don't understand why this would be any different. Juvenile records are sealed and don't generally follow you into adulthood, so what is the big deal? Send her to juvenile detention for a few months. Maybe she'll learn the lesson she needs not to do something so stupid again.

Several months in a detention centre is a bit harsh for doing something which negatively affected no-one. Robbery is a crime which creates victims, but what this girl did? Eh... It's stupid and irresponsible, and a few weeks grounding is probably in order, but prison? Come on... Whether or not it was a picture of herself is very relevant, in my opinion. There's a difference between what she did and taking pictures of a pre-pubescent getting undressed in a changing room, for instance. Prison can change a person, and having spent months away from home in a detention centre is something that's likely to stay with her.

A minor performing an explicit sex act with another minor, being photographed, and then having that photograph displayed to other people. That sounds like child porn to me. I don't care who took the pic. What about the other person in the pic? Aren't they a victim? Or was it ok because they gave consent? If that is the case then any child porn should be legal as long as the minor gives consent.

It would be different if it were just her alone in her room taking a pic of herself in the nude. Then I would agree that maybe the parents could handle it themselves and not the authorities, but that is not what happened.

Also she didn't garner any sympathy from me by tweeting about it and laughing and making a joke of it all after having left the country. She deserves more than just being grounded IMHO.

It's child porn in the sense that it's a pornographic image depicting children, but context is very very important. I'm not saying that the girl is an innocent victim, but she isn't an abuser either, in my opinion. Surely there's a difference between two stupid kids taking a picture of themselves having sex and, for instance, an adult forcing two kids to have sex while he takes pictures. The law can't be black-and-white or absolute. Allowances should be made for cases like this. JMHO.

I agree. I don't think she should be thrown into prison for life or killed, like someone who forces children to have sex against their will should be. I never said she did, but she deserves more than not being allowed to go on facebook for a couple of weeks too.
